How the Food and Drug Administration (FDA) Causes Grief to Web Marketers – How to Save Yourself

The FDA’s charter calls for it to protect us from bad pharmaceuticals and bad medicine. In fact it also protects us from good healing medicine and good alternative medicine.
The FDA is not playing games. I know way too many people personally who have been to prison or who are in prison now for me to believe otherwise.
How an inventor, healer, seller operates in this kind of environment is more “art” than science.
The FDA has a few “trigger points” that will send it into high gear â and this is my “rough” order of priority:
Claims of “cancer cures”
“Supplements” that are hormonal related â especially aimed at athletes including body builders.
Any claim of cure or treatment that is not FDA approved
I think the FDA is wrong in its approach. Wrong in its mission. And has totally hurt the healthcare system not just in the U.S. but around the world. My opinions and your opinions are irrelevant. This is a juggernaut of a beast and it will eat anyone for breakfast that gets in its way.
The enforcement arm of the FDA is the Federal Trade Commission (FTC). This is usually because the FDA claims its jurisdiction from “treatment for pay” situations. Many alternative practitioners get around this by not charging. Sometimes they take donations. Sometimes this “works” in the sense that their file is not selected for immediate trouble because they are by definition small and financially unsuccessful. But there is no true work-around to the FDA and the FTC.  When it’s your turn, you’re screwed.
Here are some things to keep in mind if you sell healthcare products on the internet:
Success is not your friend. The more of a following you have, the better your chance of getting ground up.
Complaining customers are your worst enemy. You can do a lot of smart “agreements” in dealing with sick and dying people that might give you a fighting chance in court, but nothing will stop an FDA on a mission or a customer who is angry that Gramps died on your watch while taking your “cure.” The fact that Gramps had six days to live when your protocol was used or that his immune system was killed by radiation before the family found you is not relevant. Read this carefully: THERE IS NO SUCCESSFUL DEFENSE TO AN FDA CHARGE.
Anyone selling a healthcare product on the internet is legally responsible for the claims and the sale â even if you are a downstream affiliate of a distributor or an MLM system. You cannot claim that “they” wrote the copy, not you. You are charged with being either a direct promoter or a facilitator. Neither pleasant.
What you can do to save yourself and sell your product:
Do your own research and save the results in a safe place. Get as close to third party professional studies as you can about “your” product.
Keep a journal of the research you did and why you decided the product was ok to sell.
Discover if there are complaints about the specific brand you’re selling or the product in general. Either stop selling the product if there is trouble or resolve the matter in your journal, such as, “I have found six claims in my research of 100 websites that the product does not work. I have found no adverse medical claims. I have found positive claims for the product that far out weight the negative claims. Here are the web addresses of the people who claim that it helped them.”
Be careful about your claims:
No product is 100% safe and never even think about making that kind of claim. WATER CAN KILL YOU if drunk in sufficiently large quantities.  Do you know what those quantities are? NO YOU DON’T. NOBODY DOES. EVERYONE IS DIFFERENT.
Do NOT make 100% “curative claims” â absolutely nothing — works for “everyone”.   A 30% cure rate is not sexy to advertise, but it is a major breakthrough for most serious diseases.
Investigate and notify customers on your website of any adverse claims and contraindications â RIGHT IN YOUR PROMO COPY â not buried in some weasel clause in a purchase agreement.
Quoting God or “mother nature” is not going to keep you out of prison. I don’t care if you want to be a martyr for the cause. It’s a good cause and it needs martyrs. If that’s your calling in life, then I thank you from the bottom of my heart.

By incorporating these essential elements into your overall marketing campaign, you will begin to see the cost-effective benefits of Search Engine Optimization.
1. Commit Thyself to the Process. SEO is not a one-time event. Search engine algorithms change regularly, so the tactics that worked six months ago most likely not work now or six months from now. SEO requires a long-term commitment in order to be successful.
2. Patient is a Virtue. SEO is not about instant results. Results often take months to see, and this is especially true if you are small company, and if you are new at doing business in the online world.
3. Ask a lot of questions when hiring an SEO company or Contractor. It’s important to know what kind of tactics the company or contractor uses to get you the results you desire. Ask about the techniques and practices they use. Ask if the techniques and practices they use are ETHICAL (White Hat) or UNETHICAL (Black Hat) . Then go online and do some research. Research the company, and the tactics they employ, etc.
4. Teach Yourself the SEO Way. If you’re an avid do-it-yourself (DIY) type, it’s important to become familiar with SEO and learn as much as you can. There are a million Web resources you can check out by simply googling “SEO Techniques”.
5. Install Web Analytics from the Get Go. You should have clearly defined goals in mind for your SEO implementation, and you’ll need web analytics software installed so you can track what works and what does not.
6. Build a Great Website from the Ground Up with SEO in Mind. Every business or entrepreneur wants to show up on the first page of Google or Yahoo, but consider asking yourself this: “Is my site a valuable resource for what it is I am offering? Are people going to come to my site to learn abut the product or service they want?” If not, make it so. Remember “Give” is the new “Take” when it comes to marketing yourself on the web. Give users relevant information and present it in clear and concise language that’s easy to understand.
7. Consider the Benefits of a Sitemap. Spiders will not index pages they cannot crawl. A site map helps spiders locate all of the important pages on your site, and helping them understand your site’s architecture and navigation will only serve to get you a higher rank.
8. Make SEO-friendly URLs. Use keywords in your URLs and file names, such as yourwebsite.com/productx.html.Don’t over do it though as search engines are always looking for spammy text and spammy links. If you look like spam, then expect to be treated like spam.
9. Keyword Research at the Start of the Project and Throughout the Life of your Business. Continual Keyword research is what brings you customers and visitors that convert to sales. There are seveal free versions to use like Keyword Discovery or WordTracker, and Google’s AdWords Keyword Tool,
10. Open a Pay Per Click (PPC) Account. Google’s AdWords and Yahoo’s Search Marketing are a great way to get search volume for your chosen keywords, but they cost money to use them. If your budget allows for them, then by all means use them! If you have the budget, it’s worth the investment. If you are looking for instant visibility and traffic, then this is a great option. Note: PPC Campaigns are not a “set it and forget it” solution. You must consistently monitor it or else you can risk wasting a lot of money. PPC Works well if you understand how it works.
11. Always Use Unique and Relevant Title and Meta Descriptions on Every Page on your Site. The page title is the single most important on-page SEO factor. It’s rare to rank highly for a primary term (2-3 words) without that term being part of the page title. The meta description tag won’t help you rank, but it will often appear as the text below your listing in search, so it should include the relevant keyword(s) and be written so as to encourage searchers to click on your listing.
12. Write for Users First, Search Second. Google, Yahoo, etc., have spider bots crawling the web constantly, but spiders and crawlers do not buy from you nor do they sign up for your newsletters. These are all human functions so keep humans in mind when writing articles. Nothing makes you look worse than writing an article that’s hard to read or uninteresting because its so full of spammy text or redundant text. I used to work for an SEO company here in Los Angeles that was always trying to get me to write spammy text and use UNETHICAL SEO Practices and I remember hearing the Project Manager complain on a daily basis that Google hated us for our practices(well, I refused to do it, so it wasn’t me). I was eventually laid off (Supposedly because of a bad economy, but I think it was because they were using UNETHICAL practices in SEO which I refused to do) and we just didn’t meet eye to eye. I was pretty relieved to say the least when we parted ways and business has been great for me since I left that company. I learned a lot back then and I learned that sticking to my principles has given me a very strong edge in the LA marketplace. At any rate, keep content readable.
13. Create Great, Unique Content. If you’re selling the same product or service that 100 other retailers are selling, and everyone is using the standard manufacturer descriptions, then this is your time to shine. Write your own product descriptions, using the keyword research I mentioned earlier in this article to target actual words and phrases that searchers use, and make product pages that reflect that. Another important point to consider is whether you are a retailer, service provider, writer, artist, etc., great content is a great way to get inbound links from others for free.
14. Use your Keywords as Anchor Text When Linking Internally. Anchor text helps tells spiders what the linked-to page is about. Links that say “click here” do nothing for your search engine visibility.
15. Build Links Intelligently. Submit your site to quality, trusted directories such as Yahoo, DMOZ, Business.com, Aviva, and Best of the web. Seek links from authority sites in your industry. If local search matters to you, get links from trusted sites in your geographic area—the Chamber of Commerce, etc. Analyze the inbound links to your competitors to find links you can acquire, too.
16. Start a Blog and Participate with Other Related Blogs. Search engines, Google especially, love blogs for the fresh content and highly-structured data. Beyond that, there’s no better way to join the conversations that are already taking place about your industry and/or company. Reading and commenting on other blogs can also increase your exposure and help you acquire new links. Put your blog at yourdomain.com/blog so your main domain gets the benefit of any links to your blog posts. If that’s not possible, use blog.yourdomain.com.
So here are several things to get you started in online marketing. While this is not a complete list, it will get you well on your way to becoming more visible in search.

By incorporating these essential elements into your overall marketing campaign, you will begin to see the cost-effective benefits of Search Engine Optimization.
1. Commit Thyself to the Process. SEO is not a one-time event. Search engine algorithms change regularly, so the tactics that worked six months ago most likely not work now or six months from now. SEO requires a long-term commitment in order to be successful.
2. Patient is a Virtue. SEO is not about instant results. Results often take months to see, and this is especially true if you are small company, and if you are new at doing business in the online world.
3. Ask a lot of questions when hiring an SEO company or Contractor. It’s important to know what kind of tactics the company or contractor uses to get you the results you desire. Ask about the techniques and practices they use. Ask if the techniques and practices they use are ETHICAL (White Hat) or UNETHICAL (Black Hat) . Then go online and do some research. Research the company, and the tactics they employ, etc.
4. Teach Yourself the SEO Way. If you’re an avid do-it-yourself (DIY) type, it’s important to become familiar with SEO and learn as much as you can. There are a million Web resources you can check out by simply googling “SEO Techniques”.
5. Install Web Analytics from the Get Go. You should have clearly defined goals in mind for your SEO implementation, and you’ll need web analytics software installed so you can track what works and what does not.
6. Build a Great Website from the Ground Up with SEO in Mind. Every business or entrepreneur wants to show up on the first page of Google or Yahoo, but consider asking yourself this: “Is my site a valuable resource for what it is I am offering? Are people going to come to my site to learn abut the product or service they want?” If not, make it so. Remember “Give” is the new “Take” when it comes to marketing yourself on the web. Give users relevant information and present it in clear and concise language that’s easy to understand.
7. Consider the Benefits of a Sitemap. Spiders will not index pages they cannot crawl. A site map helps spiders locate all of the important pages on your site, and helping them understand your site’s architecture and navigation will only serve to get you a higher rank.
8. Make SEO-friendly URLs. Use keywords in your URLs and file names, such as yourwebsite.com/productx.html.Don’t over do it though as search engines are always looking for spammy text and spammy links. If you look like spam, then expect to be treated like spam.
9. Keyword Research at the Start of the Project and Throughout the Life of your Business. Continual Keyword research is what brings you customers and visitors that convert to sales. There are seveal free versions to use like Keyword Discovery or WordTracker, and Google’s AdWords Keyword Tool,
10. Open a Pay Per Click (PPC) Account. Google’s AdWords and Yahoo’s Search Marketing are a great way to get search volume for your chosen keywords, but they cost money to use them. If your budget allows for them, then by all means use them! If you have the budget, it’s worth the investment. If you are looking for instant visibility and traffic, then this is a great option. Note: PPC Campaigns are not a “set it and forget it” solution. You must consistently monitor it or else you can risk wasting a lot of money. PPC Works well if you understand how it works.
11. Always Use Unique and Relevant Title and Meta Descriptions on Every Page on your Site. The page title is the single most important on-page SEO factor. It’s rare to rank highly for a primary term (2-3 words) without that term being part of the page title. The meta description tag won’t help you rank, but it will often appear as the text below your listing in search, so it should include the relevant keyword(s) and be written so as to encourage searchers to click on your listing.
12. Write for Users First, Search Second. Google, Yahoo, etc., have spider bots crawling the web constantly, but spiders and crawlers do not buy from you nor do they sign up for your newsletters. These are all human functions so keep humans in mind when writing articles. Nothing makes you look worse than writing an article that’s hard to read or uninteresting because its so full of spammy text or redundant text. I used to work for an SEO company here in Los Angeles that was always trying to get me to write spammy text and use UNETHICAL SEO Practices and I remember hearing the Project Manager complain on a daily basis that Google hated us for our practices(well, I refused to do it, so it wasn’t me). I was eventually laid off (Supposedly because of a bad economy, but I think it was because they were using UNETHICAL practices in SEO which I refused to do) and we just didn’t meet eye to eye. I was pretty relieved to say the least when we parted ways and business has been great for me since I left that company. I learned a lot back then and I learned that sticking to my principles has given me a very strong edge in the LA marketplace. At any rate, keep content readable.
13. Create Great, Unique Content. If you’re selling the same product or service that 100 other retailers are selling, and everyone is using the standard manufacturer descriptions, then this is your time to shine. Write your own product descriptions, using the keyword research I mentioned earlier in this article to target actual words and phrases that searchers use, and make product pages that reflect that. Another important point to consider is whether you are a retailer, service provider, writer, artist, etc., great content is a great way to get inbound links from others for free.
14. Use your Keywords as Anchor Text When Linking Internally. Anchor text helps tells spiders what the linked-to page is about. Links that say “click here” do nothing for your search engine visibility.
15. Build Links Intelligently. Submit your site to quality, trusted directories such as Yahoo, DMOZ, Business.com, Aviva, and Best of the web. Seek links from authority sites in your industry. If local search matters to you, get links from trusted sites in your geographic area—the Chamber of Commerce, etc. Analyze the inbound links to your competitors to find links you can acquire, too.
16. Start a Blog and Participate with Other Related Blogs. Search engines, Google especially, love blogs for the fresh content and highly-structured data. Beyond that, there’s no better way to join the conversations that are already taking place about your industry and/or company. Reading and commenting on other blogs can also increase your exposure and help you acquire new links. Put your blog at yourdomain.com/blog so your main domain gets the benefit of any links to your blog posts. If that’s not possible, use blog.yourdomain.com.
So here are several things to get you started in online marketing. While this is not a complete list, it will get you well on your way to becoming more visible in search.

You’ve simply got to keep trying, for the obvious reason that if you never swing – you’ll never hit a home run. As with most things in life, it all comes down to making good decisions. As a baby, you may think that frog looks tasty and believe that unless you can get it in your mouth – there’s no way to know for sure. Specifically, one-way inbound links from relevant pages – which search engines consider as unbiased votes of confidence in the site. Some will appear naturally over time, but you can expedite the process by adding your link to reputable directories – many of which provide free listings for quality sites.
Beyond that, your best bet is to focus on acquiring one-way links from websites relevant to yours. Keep in mind you should avoid getting too many links with the exact same text in a short period of time. And above all, don’t wait for them to come to you. Inaction is the biggest killer of dreams. Go out and find potential partners. Talk, network, make deals with your competition if you have to – but get those links. They are your best references as far as the major search engines are concerned and will override virtually any shortcoming your site may have.
In our experience, it’s better to look at Internet Marketing as more of a challenge than a race. Think of it as swimming up a slow moving creek. Some people start out cutting through the water like an Olympian, others make a lot of noise and eventually go under, but the determined few who make slow and steady progress – they are the ones who eventually prevail.
As far as trends are concerned, the Internet is barely out of diapers and the best opportunities are yet to come. Keep your antenna up and if you get an inside tip – act on it. the pagerank, the better.
The problem is that if you submit your site to a high pagerank
directory or search engine, it can take months for your site to
appear. Moreover, many high PR directories and search engines
charge big bucks for the privilege of getting listed with them.
For example, the Open Directory Project (DMOZ) directory takes
several months or more to list a site. And Yahoo charges 9
per year for a commercial site to be listed in their directory.
While it’s great to be listed in these directories and search
engines, many will automatically find and list your site free if
you have good quality links to your site. High pagerank links to
your site indicate to many search engines that other sites that
they rate highly link to you. Therefore, they conclude, your
site will probably be useful to their users. So you deserve a
higher pagerank, according to Google. And the higher your
pagerank, the better your search engine visibility. It’s part of
the SEO game and you can learn how to play.
Now here’s my secret to getting some high pagerank sites to link
to you immediately and at no charge.
First you need to create a web page on your site with a list of
links. You will be adding links to other sites on your links
page in exchange for these sites adding your link to their link
pages. So let’s call this page a reciprocal links page. You
don’t just add any site to your reciprocal links page, however.
You will be looking for high pagerank links to add to your links
page. It’s better if you include links to sites that are related
to your products or services. To make search engines happy,
limit each of your reciprocal links pages to about 50 links.
Many sites maintain their reciprocal link pages using the free
LinkMan script from PHPJunkYard. If you wish, you could do the
same, but it is not necessary. You can download this php script
from http://phpjunkyard.com
The LinkMan script allows a site’s visitors to add their links
immediately after they add links to the site on their pages. So
all you have to do is to find sites using this LinkMan script,
add their link to your reciprocal links page, and you can
immediately add your link to theirs.
Because the LinkMan script is free, the developer requires the
following notice on the links page: “Powered by Link manager
LinkMan 1.02 from PHPJunkYard – free php scripts.”
You can find sites using LinkMan then by searching for the exact
phrase “Powered by Link manager LinkMan 1.02 from PHPJunkYard”
on Google, for example. Note that there are other scripts named
Linkman, so you should not just search for “LinkMan”. Play
around with your search phrase to find also sites using earlier
versions of LinkMan.
Visit some PHPJunkYard LinkMan link pages with a browser showing
the Google pagerank. You will very soon come across a site using
LinkMan that has a high Google pagerank. Bingo! Add their link
to your reciprocal links page and then add your link to theirs.
You immediately have a free link on a high pagerank site. Free
instant SEO!
And that’s a quick and easy search engine optimization technique
you can use to generate free, high pagerank links.
